But has anyone actually been charged for being "found in" (an MP) recently? Like I posted earlier, on Ontario court ruled that an MP was not a bawdy house even though they knew that HJ's were being offered to customers. Granted, I would be more comfortable if it was the Supreme Court that made that ruling, and also I know that a cop can still arrest you even though you are likely to beat the charges. I was just wondering if it has happened to anyone recently.

Perry I know you're sick of commenting on this subject, so let me just ask you this question to
sum everything up:

If the cops do bust a MP and you're caught redhanded (no pun), the best course of action is to say nothing, call a lawyer who should be able to get you off
(provided you're not caught with drugs or anything else illegal).

Would you pretty much agree with that then????

Red handed or not, in an MP or not, the best rules are:
a) Be polite to the police and don't challenge their authority, disrespect them, or pretend you have a law degree.
b) Give the most simple and plausible 'legal' explanation possible (or say nothing).
c) DENY, DENY, DENY, DENY, admit nothing, sign nothing, and if you get charged get a lawyer.

In the case where your charge is somewhat contingent on somebody else getting charged (AKA-- Bawdy house) DON'T plead out before the case against the 'owner' is done. It's hard to be 'found in' if there was no 'bawdy house'.

I agree that you should say nothing and call a lawyer...

Whether or not a lawyer can get you off (in a manner of speaking, of course! ) depends on ALL the facts... which is why I keep on saying that each case depends on its own facts.

But it seems highly unlikely that, today, a massage parlour would be considered a bawdy house SOLELY on the basis if that a HJ was offered. But, in the past, a HJ was enough... so it would be fair to say that the law seems to be in a state of flux.

Also, if the massage is mere camouflage or excuse for a HJ (as, for example, in a massage parlour by an MPA who has no real massage skills) rather than part and parcel of a real, full body massage (as, for example, in a holistic clinic by a trained masssage therapist -- not necessarily an RMT!) then I think the risk is higher.

We need a decision by an appellate court before we can speak about certainties on this subject.

I understand if some are sick of this topic however Im completely new to this. Really the fact is that it would be equally embarrassing just to be charged even if I wasnt convicted. To clarify, the place Im interested in going, is a place that offers no extras, no nude or anything, just manual release after a massage. The place has been in business for years. I know its just anyones guess but Im just seeking advice. Is a place like this often a concern for LE, am I worrying about nothing?

I was in a popular MP when it got "visited" by LE. They went to each room, checking up on things. Girl had clothing on, I did not. Officer only asked her to "cover me up", as I was laying on my stomach at the time. Made the whole experience rather interesting.

If you've read the two pages above, bigtime let alone the many other threads from times past on the topic, you've probably figured out that, absent a crusade from a chief or councillor, LE has better things to do than bust a quiet, well-behaved massage joint that massages joints as well as muscles. But quiet and well-behaved are relative terms, and the real danger is from the good relations the spa has—or worse, doesn't have—with its neighbours and landlord.

Of course you're not worrying about nothing, but don't expect certainty. Ben Franklin answered that one long ago.

No quasi-legal advice here, just a story from 2001 in the glory days of the Rivermede MP Era in my younger days....

Was in an MP around 2am with a couple of buddies after a WAGG visit and the cops came in and the attendant told me to get dressed while she exited the room and closed the door. I eventually came out and the cops eyed me up and down, had some conversations with the ladies and left...

Before they left, the popo did mention how stupid we were for being there considering the same cops "busted" us in the back of an industrial building parking lot pounding some king cans and smoking some weed about 5 hours earlier before the WAGG visit....I use the term busted loosely, as it was just a warning to leave Vaughan and he made me watch as he ground the rest of my stash into the asphalt lol.

Morals of this story (if any):
1) If you frequent MP's, there will always be a chance of being present during a police visit;
2) IMHO the cops were just letting their "presence" be felt by the establishment and the unlucky customers;
3) If you are present during an LE visit, pray that it is only for muscle-flexing purposes, and not politically motivated purposes.

yup! This was probably 6 to 8 months ago. We chuckled about how embarrasing it was. Took a little longer than normal due to the "stress", but she was very apologetic. From what I understand, the establishment was fined, as she didn't have me covered up at the time.

Scared the holy bejesus out of me, but the MPA handled it like a champ!

Some cities like Vaughan (suburb of Toronto) are going after unlicensed body rub parlors under the rarely enforced bawdy house law that makes incall prostitution illegal, while outcall has always been legal.

Justice Howard Chisvin, of the Ontario Court of Justice, dismissed two bawdy house charges against a body rub manager saying: "The payment of money was for a full-body massage. The act of masturbation was optional, at no additional fee. I wonder, and am left in doubt as to whether or not the community might consider the act of masturbation in all situations to be sexual."

The judge then made a reference to Clinton's liaison with the intern. "One only needs to look to the conduct of a certain president of the United States and ... the activity that he participated in to wonder whether or not the act of masturbation is indeed, in all circumstances, a sexual act."

Will the judge's ruling open the flood gates for more "happy endings" at rub and tugs without fear of police prosecution? Lawyer Alan Gold says it's too early to tell. But he said he believed the judgment to be unprecedented and said it will be in the next issue of his Criminal Law Netletter, a collection of "novel and important" cases.

In his ruling, Chisvin was critical of the undercover York Regional police officer in the case. The court heard how the officer stripped naked, lay first on his stomach and then flipped over for the female attendant, stopping her when she put her oiled-up hands on his penis.
He went to the massage parlour again, going through the drill with another attendant. "It strikes me that his actions were not only unnecessary but outside a protocol of investigative techniques of offences of this nature and bordered on no more than attending for self-gratification."

Unless it's challenged in appeals court, it becomes legal precedent. The judge has defined that a HJ in itself is not prostitution if no dealing took place, and that it wasn't an indecent act that would have made the place a common bawdy house. Lets hope that, in the future, the justice system spends its time prosecuting real crime, instead of stimulation between consenting adults.
