Thanks for two more informative posts. I still go and plan on going to MPs it was just a thought.... wanted to know what would happen. Its called curoisity. Considering how I'm sure of the 1600+ posts most are not of any use what are you doing complaining? HJ's are indeed criminal sex acts in the bawdy house context. The Ontario Court of Appeal decided this definitively about 8 years ago in the "bondage bungalow" case and the Supreme Court refused to hear the appeal - which means they basically back the Ont C A. There are more recent cases on strip clubs which suggest that groping without a hj may also be a sex act within the bawdy house context, but these are lower court decisions and are not widely influential on the state of the law. But they're still out there to scare you.

Fact is, the legal jeopardy in going to an MP is about the same as going to an incall escort. You can be successfully busted in both.

I think that case shows how ridiculous the law is. From what I remember reading in a short newspaper article, her last appeal was rejected because her insisting that no sex acts were occurring was judged to be irrelevant, since the silly S&M stuff was by itself "indecent" and enough for a conviction on the bawdy-house charges. That law is used to charge bath houses and swingers clubs, not just places where prostitution occurs.

if you are in a MP and anyform of "sexual activity" as defined is occuring,you just for being present in the MP can be charged as a "found in".
It is a criminal charge and will rquire a defence in court as previously stated.
The reputation of the MP interms of "low mileage" is irrelevant if the place is entered by the police and they decide to lay common bawdy house charges.
If you are present inside the establishment EVEN sitting fully dressed in the waiting room, you CAN get charged.
For the purposes of the charges without going into the obvious act so intercourse, fellatio and cunalingus, HJ's "russian release and anyother "touching of genatalia" as defined in the criminal code with or without a release, is a chargable offence ......YOU CAN GET CHARGED.

Okay, Perry. I looked up a synopsis of R. v. Ni in Martin's. But does it help you?? It basically says that prostitution is made out when the MPA's jerk off the customers. Which is what I say as well.

There's more, scarier stuff in Martin's. For instance, R. v. St-Onge (Quebec C. A.) seems to have involved a type of SC. The customers jerked off while the dancers performed lewd dances for them. That too, was held to be prostitution on the part of the dancers and the arrest upheld. The "bondage bungalow" case is quoted by Martin's for the proposition that s&m acts alone which sexually excited the customers were prostitution. (I always read that case as being decided on the fact that the dom jerked the guy off, but maybe my aging oagre-memory is playing me false.)

Based on this stuff, a nude BS alone is an act of prostitution! You don't even have to have a finish!!!

Actually, the sex act is not criminal, a bawdy house is

If you are caught you will be charged as a "found-in", that is the criminal charge

If you are not worried about embarassment you stand up in court and state "I was in a licensed massage receiving a non-sexual massage"

that is your defense

if you are caught with your pants down, ie caught in a sexually compromising position, then it could be argued that you knew you were in a bawdy house and you would be found guilty

your defense is that you had a legitimate reason for being there

Actually by being funny you make a good point, and that is exactly what many of the court cases have to deal with, definitions. To be guility you have to be a found-in of a bawdy house. To be a bawdy house it has to be common and acts of prostitution or lewdness have to occur.

Perry Mason's argument that a HJ is not an act of prostitution is very good and I would love to see someone argue that in front of a court. All you need is one victory to get things changed. Of course they would have to buy into the idea that a HJ is incidental to the massage and that the money paid was for a massage. Even so, once accepted, the police would not bother charging places where you can only get a HJ, which they do now informally.

After a HJ is a legally accepted practice, you then need to apply similiar arguments to BJ's
