The woman alleges in the lawsuit that the assault happened during a massage session in 2022, according to court documents.
FRISCO, Texas — A woman is suing a North Texas massage parlor, alleging she was sexually assaulted during a massage session there, according to court documents.
The woman alleges the sexual assault happened during a session at Elements Massage in Frisco in July of 2022 when a man, identified as Dominique Gutierrez, inappropriately touched her, then held her down so she couldn’t move until he stopped and covered her with a sheet, court documents stated.
The lawsuit was filed Tuesday in Collin County and names both Gutierrez and Elements Therapeutic Massage.
“[The woman] was in shock and fear for her safety, and quickly put her clothes on and ran and hid in the bathroom area, messaging her husband to come get her immediately while having a panic attack,” according to the lawsuit. “[The woman] left Elements Frisco still in shock over the assault and the invasive, inappropriate touching she had experienced. [The woman] remained in this numb and disoriented state and required significant mental health treatment, which she continues to require to this day.”
The woman’s husband reported the alleged assault to police the day it happened, and Gutierrez was arrested on a complaint of sexual assault after police interviewed him, according to a Frisco police arrest report.
“Dominique when being questioned after having been read his Miranda Rights stated that the massage went like most of his massages. When Dominique was questioned why he stated … that some of his massages don't want him touching around their legs,” according to the arrest report.
In 2024, Gutierrez pleaded guilty to attempted sexual assault and was placed on probation for four years, received a $200 fine, and was ordered to have no direct contact with the woman, court records showed.
The woman alleges in the lawsuit that she “struggled and continues to struggle to perform her job duties” after the incident and “continues to see a therapist to address the trauma resulting from the assault.”
WFAA has reached out to Elements Massage for comment on the lawsuit.
The woman is seeking damages for “past and future mental anguish,” medical expenses, court costs, past and future lost wages, and more, according to the lawsuit.
